Fine schedule
A fine schedule is a written policy, adopted by the board, that sets the amount of the fine for each category of violation and how it escalates — for example, a warning, then a first fine, then a larger fine for each further week the violation continues, up to a cap.
Publishing the schedule in advance is what makes fines predictable and defensible. The board's power to fine has to come from the CC&Rs or state law, and many statutes add procedural steps before a fine is valid: written notice of the violation, a chance to cure it, and an opportunity for a hearing. Some states also cap fine amounts or bar foreclosure for fines alone.
Applying the schedule the same way to every owner protects the board against claims of selective enforcement.
