What North Carolina HOA boards need to comply with
North Carolina Planned Community Act (N.C. Gen. Stat. ch. 47F). Chapter 47F governs planned communities created on or after January 1, 1999, and its core sections on fines, meetings, assessments, liens, and records also reach older communities. It sets an owner-ratification process for the annual budget, a hearing requirement before fines, and a multi-step lien and foreclosure procedure.
- Send owners a summary of the proposed budget and hold a meeting at which it is ratified unless a majority of all owners reject it.
- Give an owner notice and a hearing before the board or an adjudicatory panel before imposing a fine or suspending services.
- Send the required pre-lien statement before filing a claim of lien for unpaid assessments, and follow Chapter 47F’s separate steps before any foreclosure.
- Make financial records and board and association meeting minutes reasonably available for owner examination.
This is general information, not legal advice. Self-managed boards should review the statute and their governing documents with counsel before making compliance decisions.
