Covenant enforcement
Also called: Violation enforcement
Covenant enforcement is the process an association uses to bring an owner back into compliance with the CC&Rs and rules — an unapproved fence, trash cans left out, a rental that breaks the lease rules.
A defensible process usually follows the same steps: document the violation with dates and photos; send a written notice that cites the rule and gives a reasonable time to cure; offer a hearing before the board if a fine is coming; apply the published fine schedule; and escalate to legal action only for serious or persistent cases. Many states write some of these steps into statute.
Two habits protect the board most: treat identical violations identically, and keep every notice and response in the record. Inconsistent enforcement can cost an association the right to enforce a rule at all.
